ARTIST PERFORMANCE RELEASE AGREEMENT FOR INDIE MUSIC CHANNEL - LIVE

I am over 18 years of age and have accurately submitted identifying information about myself and my music group (“band”) on the form provided herein.  I have carefully read and understand the terms and meaning of this Artist Performance Release Agreement (“Agreement”).  By clicking on the "Submit"button on the submission form screen of this Agreement, I consent and agree that, for valuable consideration I will receive by my appearance on the program entitled "Indie Music Channel - Live" (the “program”), I hereby irrevocably grant an unrestricted license to Metro Media Group, Inc. and Indie Music Channel to use my physical and audible likeness and appearance, as well as the recording of the music I will be performing on the program for broadcast, and re-broadcast, on television, radio and internet streaming.   I further grant to Metro Media Group Inc. and Indie Music Channel an unrestricted license to distribute in any medium, any portion of the program, including but not limited to my appearance and my music performed therein, in whole or in part, without any further consideration or direct financial compensation to me.  I waive any exercise of creative control over the program, nor will I authorize or permit anyone associated with me or my music, including, but not limited to, my other band members, my musicians,  my record label, my agent, my manager and/or my publisher as a   result of playing or promoting myself or my music in the production to assert such rights as I have licensed herein. I also understand that my appearance and likeness will not be intentionally defamed in any way on the program.  I also agree that I and, to the extent that I may have authority over them, the members of my band, staff or entourage, will act in a professional manner at all times while on stage performing and throughout the program; to refrain from using any profane or inappropriate language or gestures of any kind while on stage, and will not perform on stage while intoxicated or under the influence of any alcohol or non-prescribed drug or excessive use of a prescribed drug.  I understand and agree that Metro MediaGroup, Inc. and Indie Music Channel reserve the right to refuse or revoke my permission to perform during the program and may refuse to distribute my performance for any reason at any time.  I also agree that, unless otherwise set forth in writing, Metro Media Group, Inc. and  Indie  Music Channel are not responsible for any reimbursements to me or anyone associated with me, for any travel costs, lodging, etc., associated with my participation in this program.  I also agree to hold harmless Metro Media Group,Inc. and Indie Music Channel and all of their principals, agents and employees and parties involved in the making of the program, from damages that may be incurred or for any injury that may occur to me or my band related to the program. Further, I also understand that electronic and mechanical failures do happen, and therefore I agree that Metro Media Group, Inc. and Indie Music Channel are not responsible for any possible failure of the recording equipment used to record the performance of myself or my band, and that should any such recording failure occur, I will not expect, or receive, any additional opportunity to conduct my performance again.   I also understand that if I or my band decide(s) to reproduce a CD or other marketable product of the performance on the program (as permitted by Metro Media Group, Inc. and Indie Music Channel) that I or we must   produce  finished graphics and proposed packaging for the CD or product, and that such packaging must receive the approval of Metro Media Group, Inc. and Indie Music Channel prior to any recorded performance being released to me or my band for reproduction.  Subsequent to receiving such approval, I may not alter the graphics and proposed packaging without the express permission of MetroMedia Group, Inc. and Indie Music Channel.  I certify that I have the authority to enter into this agreement on behalf of myself and my band so as to pledge to fully comply with all terms of this Release Agreement.   I understand that if I am making this submission on behalf on a minor child, by clicking on the "Submit Button" on the Submission Page, I am representing and asserting that I have the legal fiduciary capacity to so agree with these terms on my own behalf and on behalf of said child.
