ARTIST PERFORMANCE RELEASE AGREEMENT FOR INDIE MUSIC CAFE - LIVE PERFORMANCE

I am over 18 years of age and have accurately submitted identifying information about myself and/or my music group (“band”) on the form provided herein. I have carefully read and understand the terms and meaning of this Artist Performance Release Agreement (“Agreement”). By clicking on the "Submit" button on the submission form screen of this Agreement, I consent and agree that, for valuable consideration I will receive by my appearance on the program entitled "Indie Music Cafe" (the “program”), I hereby irrevocably grant an unrestricted license to Metro Media Group (owner of the program) to use my physical and audible likeness and appearance, as well as the recording of the music I will be performing, on the program. I further grant to Metro Media Group an unrestricted license to distribute in any medium any portion of the program, including, but not limited to, my physical appearance and my music performed therein, in whole or in part, without any further consideration or financial compensation to me and/or anyone associated with my music. I waive any exercise of creative control over the program, and I will not authorize or permit anyone associated with me or my music, including, but not limited to, my other band members, my musicians, my record label, my agent, my manager and/or my publisher, as a result of playing or promoting myself or my music in the production, to assert such rights as I have licensed herein. I also understand that my appearance and likeness will not be intentionally defamed in any way on the program. I also agree that I and, to the extent that I may have authority over them, the members of my band, staff or entourage, will act in a professional manner at all times while at the venue and on stage performing throughout the program; to refrain from using any profane or inappropriate language or gestures of any kind while on stage, and will not perform on stage while intoxicated or under the influence of any alcohol or non-prescribed drug or excessive use of a prescribed drug. I understand and agree that Metro Media Group and the venue where the taping is taking place, reserve the right to refuse or revoke my permission to perform during the program and may refuse to broadcast my performance for any reason at any time. I also agree that, unless otherwise set forth in writing, Metro Media Group, Indie Music Cafe, the performance venue and any sponsors, are not responsible for any reimbursements to me or anyone associated with me, for any travel costs, lodging, etc., associated with my participation in this program. I understand that this is an "airplay for exposure" exchange and that my performance of music during the taping of the program does not automatically guarantee inclusion or acceptance of my appearance on the show. I further agree and acknowledge that if any of my songs that are being performed are registered with ASCAP, BMI or any other performance rights organization, I fully waive my rights to the collection of any and all fees and/or compensation associated with any performances rights organizations, music licensing organizations, etc., as it pertains to the performance and airing of my music and performance on the above mentioned show(s), production(s) and/or opportunities. Metro Media Group, Indie Music Cafe and their associated station broadcasters and performance venues take pride in providing performance opportunities for independent artists solely on the merit and talent of the artist submitting to perform. It must be understood that all songs and performances must meet certain professional broadcasting criteria and Metro Media Group, Inc. and their associated station broadcasters reserve the right to refuse any song or performance for any reason. I also agree to hold harmless Metro Media Group, Inc. and all of their principals, agents and employees, sponsors, taping venues and other parties involved in the making of the program, from damages that may be incurred or for any injury that may occur to me or my band related to the program. Further, I also understand that electronic and mechanical failures do happen, and therefore I agree that Metro Media Group, Inc. is not responsible for any possible failure of the recording equipment used to record the performance of myself or my band, and that should any such recording failure occur, I will not expect, or receive, any additional opportunity to conduct my performance again. I certify that I have the authority to enter into this agreement on behalf of myself and my band so as to pledge to fully comply with all terms of this Release Agreement. I understand that if I am making this submission on behalf on my minor child, by clicking on the "Submit Button" below, I am representing and asserting that I have the legal fiduciary capacity to so agree with these terms on my own behalf and on behalf of said child. Metro Media Group takes great pride in creating outstanding opportunities for independent singers and bands in an effort to help them reach their goals for their music career.

The TV Show

- "Red Carpet" arrivals in the restaurant lobby starts at 6:30pm

- Open Mic and TV show taping starts at 7pm

- The "Indie Music Cafe After Party" starts immediately following the taping and Open Mic where artists, musicians, managers, publishers, recording studio reps, etc., can hang out and network with each other! Be sure to bring lots of business cards, CDs, etc!

Performance Information

- The taping will be in front of an audience.
It's free to attend the taping, so invite your friends to watch you jam!

- You can perform up to 2 songs.

- No profane lyrics or dialog permitted while on stage.

- All songs performed MUST be originals, no covers.

- Backline will be provided (speakers, amps, drums, etc.),
so just bring your guitars and drumsticks and be ready to jam!

- You will be allowed to sell merchandise (CDs, tee shirts, etc.) and keep 100% of the proceeds!

- Discounted parking validation available for all artists performing in the Open Mic!
